Thmanyah’s Font License

Downloading, installing, or using the Font Software constitutes your acceptance of, and agreement to be bound by, the terms of this Thmanyah Font License (the “License”). If you do not agree to these terms, you may not download, install, or use the Font Software.

PREAMBLE

Thmanyah Publishing & Distribution Company (the “Company”) grants you a limited license to use the Thmanyah font family solely for the personal and commercial design purposes expressly permitted under this License, while protecting the integrity of the original design and preventing any unauthorized distribution or modification.

DEFINITIONS & INTERPERTATIONS

"Font Software" refers to the thmanyah font files provided by Thmanyah Publishing and Distribution.

"Derivative Works" means any work based on or derived from the Font Software, including modification, alteration, renaming, or republication as another font.

“You” or “you” means the individual or legal entity, and any authorized users acting on its behalf, that downloads, installs, or uses the Font Software in accordance with this License.

"Font Software" refers to the thmanyah font files provided by Thmanyah Publishing and Distribution.

"Derivative Works" means any work based on or derived from the Font Software, including modification, alteration, renaming, or republication as another font.

Unless the context requires otherwise: (a) headings are for convenience only and do not affect interpretation; (b) words in the singular include the plural and vice versa; (c) references to “including” or “include” mean “including without limitation”; (d) references to any law or regulation include any amendment, re-enactment, or replacement thereof; and (e) if any inconsistency arises between provisions, the provision that best gives effect to the commercial purpose of this License shall prevail, to the extent permitted by applicable law.

PERMITTED USES

You are granted a non-exclusive, non-transferable license to:

Use the Font Software for personal projects.
Use the Font Software commercially in logos, branding, websites, applications, printed materials, and any other design work.
Embed the Font Software in documents, applications, or products you create.
Embed the Font Software in websites, web applications, mobile applications, or software products only as part of a compiled, packaged, or obfuscated product.

Redistribute, share, upload, host, or make the Font Software available for download on any website, server, digital platform, or file-sharing service. The Font Software may only be downloaded from the official thmanyah website (font.thmanyah.com) and used on your own devices and projects.
Make the Font Software available in any manner that allows end users or third parties to extract, download, access, reuse, or redistribute the Font Software independently as font files, including through web embedding, applications, or software products.
Modify, edit, adapt, translate, or reverse-engineer the Font Software in any way.
Create Derivative Works or republish the Font Software as a new or different font.
Remove, alter, or obscure any copyright notices, trademarks, or identifying marks in the Font Software.

TRADEMARK AND BRAND USE

“thmanyah” is a name and brand associated with Thmanyah Publishing and Distribution company. This license does not grant permission to use the Thmanyah name, logo, or branding in any manner that suggests endorsement, sponsorship, or affiliation, except as necessary to identify the Font Software itself.

ENFORCEMENT

Violations of this license will result in:

Immediate demand for removal of the Font Software from all materials and platforms.
Revocation of your license to use the Font Software.
Potential legal action for copyright infringement, including damages and costs.

TERMINATION

All provisions of this License are material. The Company may terminate this License immediately, without prior notice, in the event of any breach of its terms and conditions, which shall constitute a material breach. Such termination shall not prejudice the Company’s statutory rights to seek compensation or to take any other legal action. You further undertake to immediately cease any use of the Font Software and destroy all copies in your possession or under your control.

GOVERNING LAW

This license is governed by the laws of the Kingdom of Saudi Arabia. Any disputes will be resolved in the courts of Riyadh, Saudi Arabia.

LANGUAGE

In the event this license is translated into another language, the Arabic version shall prevail.

DISCLAIMER

THE FONT SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY APPLICABLE LAWS. YOU ACKNOWLEDGE THAT YOUR USE OF THE FONT SOFTWARE IS AT YOUR SOLE RISK, AND THAT THE COMPANY DOES NOT WARRANT THAT THE FONT SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL SYSTEMS OR DEVICES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF, OR INABILITY TO USE, THE FONT SOFTWARE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF PROFITS, OR THIRD-PARTY CLAIMS. IN ALL EVENTS, THE COMPANY’S LIABILITY (IF ESTABLISHED AS A MATTER OF LAW) SHALL BE LIMITED TO THE MINIMUM EXTENT PERMITTED BY APPLICABLE LAWS, AND SHALL NOT EXCEED (IF A MONETARY CAP IS REQUIRED) THE AMOUNT OF THE APPLICABLE LICENSE FEE PAID (IF ANY)

GENERAL PROVISIONS

This License constitutes the entire agreement between you and the Company with respect to your use of the Font Software, and supersedes all prior understandings, communications, or correspondence relating to the same subject matter. No amendment to, or exception from, this License is effective unless made in writing and issued by the Company.

No failure or delay by the Company in exercising any right under this License operates as a waiver of such right, nor does it prevent the Company from exercising that right or any other right at any later time.
If any provision of this License is held to be invalid or unenforceable, in whole or in part, such invalidity or unenforceability does not affect the validity of the remaining provisions, which shall remain in full force and effect to the extent permitted by applicable laws. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intended commercial purpose of the original provision and is consistent with applicable laws.
You may not assign this License or transfer any of your rights or obligations hereunder, in whole or in part, to any third party without the Company’s prior express written consent.
Nothing in this License creates any partnership, agency, employment, or other legal representation relationship between you and the Company. This License is limited solely to granting the right to use the Font Software in accordance with its terms.

Your continued downloading, installation, or use of the Font Software after the effective date of any amendment constitutes your acceptance of the updated License. For the avoidance of doubt, no amendment shall affect rights granted to you prior to the effective date of such amendment with respect to uses properly made before that date, unless the amendment expressly provides otherwise and to the extent consistent with applicable laws.
